These Website Terms of Use ("Website Terms") govern access to and use of the website operated by West Industrial Company Limited ("WIC", "we", "our" or "us"). They incorporate WIC’s Cookies Policy and should be read alongside WIC’s Privacy Policy.
By accessing or using the Website, you agree to these Website Terms. If you do not agree, you must cease using the Website. Where consent is legally required for a cookie or similar technology, use of the Website alone does not constitute consent.

2. APPLICATION AND CONTRACTUAL STATUS
These Website Terms govern use of the Website only. They do not govern the supply of consultancy, operational systems, support services or other professional services.
Any contract for Services or Deliverables is formed and governed exclusively in accordance with WIC’s Business Terms and Conditions and the applicable Quotation, Purchase Order and Sales Order Confirmation. If there is any inconsistency, the Business Terms and Conditions and the relevant Contract documents prevail.
Nothing on the Website varies any existing Contract or authorises any person to vary WIC’s Business Terms and Conditions.
3. WEBSITE ACCESS
Access to the Website is provided on a temporary and as-available basis. WIC may modify, suspend, withdraw, restrict or discontinue all or any part of the Website without prior notice.
WIC does not guarantee that the Website, or any content on it, will always be available, uninterrupted, secure or free from defects.
4. INTERNATIONAL ACCESS
The Website is operated from England. Although it may be accessed internationally, WIC makes no representation that its content or Services are appropriate, lawful or available in every jurisdiction.
Persons accessing the Website outside the United Kingdom do so at their own risk and are responsible for compliance with applicable local law.
5. BUSINESS USERS AND AGE
The Website is intended primarily for businesses and persons acting in the course of business. By submitting an enquiry, booking a meeting or otherwise providing information through the Website, you confirm that you are at least 18 years old and have authority to act for the relevant business where applicable.
6. NO CONTRACT OR PROFESSIONAL ADVICE THROUGH THE WEBSITE
The Website provides general information about WIC and its Services. Nothing on the Website constitutes an offer capable of acceptance, a binding contractual commitment, or legal, engineering, operational, financial or other professional advice.
Submitting an enquiry, booking a meeting, downloading a resource, making a payment or corresponding through the Website does not of itself create a Contract. A Contract is formed only when WIC issues a Sales Order Confirmation and unique Sales Order Number in accordance with its Business Terms and Conditions.
WIC may decline any enquiry or proposed engagement at its discretion.
7. PERMITTED USE
You may use the Website solely for lawful business purposes. Subject to these Website Terms, you may view Website content, download resources where expressly permitted, and contact WIC regarding its Services. No other rights are granted.
8. PROHIBITED USE
You must not:
use the Website for any unlawful, fraudulent or malicious purpose;
interfere with, damage or disrupt the Website, its hosting, networks or connected systems;
introduce viruses, malware, ransomware, trojans, spyware, malicious scripts or other harmful material;
attempt unauthorised access, security testing, vulnerability scanning or penetration testing without WIC’s prior written permission;
reverse engineer, frame, mirror or reproduce any part of the Website except as permitted by law;
impersonate another person or organisation or submit false, misleading or unauthorised information;
harvest contact details or use automated software, bots, scripts or scraping tools to collect Website content or data;
use Website content to train, fine-tune, evaluate or populate artificial intelligence systems, machine-learning models, large language models or datasets without WIC’s prior written consent; or
reproduce, distribute, publish, license, sell or commercially exploit Website content without WIC’s prior written consent.
9. INTELLECTUAL PROPERTY
Unless otherwise stated, all intellectual property rights in the Website and its content belong to WIC or its licensors. This includes text, graphics, branding, logos, layouts, documents, templates, frameworks, reports, downloadable resources, methodologies, software and designs.
All rights not expressly granted are reserved. Nothing on the Website transfers ownership of WIC’s methodologies, methods, know-how, templates, frameworks, architecture, logic, techniques, concepts or reusable components.
10. TRADE MARKS
The name West Industrial Company and all associated branding, logos and visual identity are proprietary to WIC. No licence or right to use them is granted without WIC’s prior written consent.
11. DOWNLOADABLE MATERIALS
Where WIC makes materials available for download, they are supplied under a limited, revocable, non-exclusive and non-transferable licence for the recipient’s own internal business use only.
Unless WIC agrees otherwise in writing, you must not resell, reproduce, distribute, modify, publish, license or commercially exploit any downloadable material.
12. WEBSITE INFORMATION
WIC endeavours to keep Website content accurate and current but does not warrant that it is complete, accurate, current or free from error. Content may be changed or removed without notice.
You are responsible for evaluating whether any information is suitable for your circumstances and for obtaining appropriate professional advice before acting on it.
13. THIRD-PARTY WEBSITES AND SERVICES
The Website may contain links to or integrations with third-party websites and services, including Calendly for meeting bookings and Stripe for online payments. Third parties operate independently and their own terms, privacy notices and cookie policies apply.
WIC does not control and is not responsible for the availability, security, content, cookies, processing practices or performance of any third-party website or service. A link or integration does not constitute endorsement.
14. COOKIES AND SIMILAR TECHNOLOGIES
14.1 This Clause is WIC’s Cookies Policy. It explains how the Website uses cookies and similar technologies that store information on, or access information from, a user’s device.
14.2 Cookies are small text files placed on a device by a website. Similar technologies may include local storage, scripts, tags and other technologies used to operate or secure an online service.
14.3 The Website currently uses only technologies WIC considers necessary for the operation, security and requested functionality of the Website. These may include technologies required to operate the Squarespace platform, preserve security and functionality, and remember cookie-consent choices.
14.4 Strictly necessary technologies may be used without consent where the law permits. WIC will nevertheless provide clear information about their use. A technology is not treated as strictly necessary merely because it is convenient or useful to WIC.

At the Effective Date of these Website Terms, WIC uses only cookies and similar technologies that are strictly necessary for the operation, security and delivery of the Website, including those required to operate the Squarespace platform and to remember a user's cookie preferences.
Where a cookie is strictly necessary within the meaning of applicable law, your consent is not required before it is placed. WIC does not currently use analytics, advertising or other marketing cookies.
Should WIC introduce any such cookies or similar technologies in the future, they will not be deployed unless the necessary information has been provided and any consent required by applicable law has first been obtained.
Where users choose to access third-party services through or from the Website, including Calendly for meeting bookings or Stripe for online payments, those providers may place their own cookies or similar technologies. You must not knowingly compromise or attempt to compromise the Website or its infrastructure. Suspected unlawful activity or attacks may be preserved as evidence and reported to relevant service providers, regulators or law-enforcement authorities.

Nothing in these Website Terms excludes or limits liability for death or personal injury caused by negligence, fraud, fraudulent misrepresentation, or any liability that cannot lawfully be excluded or limited.
Subject to the preceding paragraph and to the fullest extent permitted by law, WIC excludes liability arising from reliance on Website information, Website interruption or unavailability, technical failure, inaccuracy, omission, loss or corruption of data, indirect or consequential loss, loss of profit, revenue, production, opportunity, anticipated saving, goodwill or business.
Nothing on the Website guarantees any commercial, operational or financial outcome.
18. CLIENT CONFIDENTIALITY, TESTIMONIALS AND CASE STUDIES
WIC respects client confidentiality. WIC will not publicly name a client, use its logo, or publish an identifying testimonial or case study without the client’s prior written consent, consistently with WIC’s Business Terms and Conditions and any applicable confidentiality agreement.

You may link to the Website in a lawful and fair manner that does not damage WIC’s reputation or suggest an association, approval or endorsement where none exists. WIC may withdraw linking permission at any time.

20. CHANGES TO THE WEBSITE TERMS
WIC may amend these Website Terms for future Website use by publishing an updated version. The effective date will be shown at the beginning of the document.
Changes to these Website Terms do not amend an existing Contract. Any amendment to an existing Contract must occur in accordance with WIC’s Business Terms and Conditions.
21. SEVERABILITY
If any provision is unlawful, invalid or unenforceable, it shall be modified to the minimum extent necessary or deleted, and the remaining provisions shall continue in force.
22. WAIVER
A waiver is effective only if given in writing and applies only to the specific circumstances for which it is given. A failure or delay to exercise a right is not a waiver of that right.
